TERMS & CONDITIONS

1. INTRODUCTION

Welcome to Ndaya Chauffeurs ("Company," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our services, including Chauffeur Services, Auto Logistics, and Rentals (both Peer to-Peer and Standard). By accessing or using our services, you agree to be bound by these Terms and any policies incorporated herein. If you do not agree, please refrain from using our services.

2. DEFINITIONS
  • "Customer" refers to any individual or entity that engages with Ndaya Chauffeurs for services.
  • "Chauffeur Services" refer to the provision of professional drivers for hire.
  • "Auto Logistics" refers to vehicle transportation, import/export facilitation, and fleet management services.
  • "Rentals" refers to both standard vehicle rentals and the peer-to-peer (P2P) car hire service.
  • "P2P Service" allows vehicle owners to list and rent their cars through our platform.
  • "User" refers to any person using our website, mobile applications, or other service platforms.
3. GENERAL CONDITIONS
  • 3.1. All users must be at least 18 years old and legally capable of entering into a contract under Kenyan law.
  • 3.2. We reserve the right to modify these Terms at any time. Changes will take effect upon posting to our website.
  • 3.3. Users must provide accurate and truthful information during registration and booking.
4. CHAUFFEUR SERVICES
  • 4.1. Chauffeur services are provided based on availability, and bookings must be made in advance.
  • 4.2. Customers must treat chauffeurs with respect and comply with safety regulations.
  • 4.3. Any damage to the vehicle caused by the Customer will be billed to the Customer.
  • 4.4. Cancellations made less than 24 hours before the scheduled time may attract a cancellation fee.
  • 4.5. Ndaya Chauffeurs is not liable for delays caused by traffic, weather, or unforeseen circumstances.
5. AUTO LOGISTICS SERVICES
  • 5.1. Our auto logistics services include vehicle transport, importation, and fleet management.
  • 5.2. Customers must ensure all necessary documentation for import/export is provided.
  • 5.3. Ndaya Chauffeurs shall not be liable for any delays caused by customs, regulatory bodies, or force majeure.
  • 5.4. Vehicles transported must have valid insurance coverage.
  • 5.5. Any damage claims must be reported within 24 hours of delivery.
6. RENTALS (STANDARD & P2P)
  • 6.1. Renters must present a valid driving license and national identification/passport.
  • 6.2. A security deposit may be required for all rentals.
  • 6.3. Renters are responsible for any fines, penalties, or damages incurred during the rental period.
  • 6.4. The rental period begins when the vehicle is handed over and ends when it is returned to the agreed location.
  • 6.5. Late returns may attract additional charges.
7. PEER-TO-PEER (P2P) CAR HIRE SERVICE
  • 7.1. Vehicle owners who list their cars on our platform must ensure the vehicles are roadworthy and insured.
  • 7.2. Renters must comply with all applicable traffic laws and regulations.
  • 7.3. Ndaya Chauffeurs only acts as an intermediary and is not responsible for disputes between car owners and renters.
  • 7.4. Owners retain full responsibility for vehicle maintenance and insurance compliance.
  • 7.5. Any disputes must be reported within 24 hours of the rental period ending.
8. PAYMENT TERMS
  • 8.1. Payments must be made in full before service commencement unless otherwise agreed.
  • 8.2. All fees are non-refundable unless stated otherwise.
  • 8.3. Payment disputes must be raised within seven (7) days of the transaction.
  • 8.4. We accept payments via mobile money, bank transfer, and credit/debit cards.
9. LIABILITY & INDEMNITY
  • 9.1. Ndaya Chauffeurs shall not be liable for any loss, injury, or damages arising from the use of our services.
  • 9.2. Customers and users agree to indemnify and hold Ndaya Chauffeurs harmless from any claims or liabilities arising from their use of our services.
  • 9.3. We shall not be responsible for any third-party misconduct, including theft or negligence.
10. TERMINATION
  • 10.1. We reserve the right to terminate services to any user who violates these Terms.
  • 10.2. Users may terminate their engagement by providing written notice.
  • 10.3. Outstanding balances must be settled before termination is finalized.
11. DISPUTE RESOLUTION
  • 11.1. Any disputes arising under these Terms shall be resolved through mediation and arbitration in Kenya.
  • 11.2. If arbitration fails, disputes shall be referred to Kenyan courts under applicable laws.
12. GOVERNING LAW
  • These Terms shall be governed by and construed in accordance with the laws of Kenya.
